Changes needed in Texas Penal Code

Proposed Penal Code changes are contained in H.B. 906 by Rep. Phil King.

The changes would exempt Reserve
from Sections 46.02 and 46.03 which
forbid persons from carrying a weapon.

SECTION 1. Section 46.15(a) Penal Code is amended to read as follows:

(a) Sections 46.02 and 46.03 do not apply to:

(1) peace officers and neither section prohibits a peace officer from carrying a weapon in this state regardless of whether the officer is engaged in the actual discharge of the officer's duties while carrying the weapon.

(5) a reserve law enforcement officer licensed under Chapter 415, Government Code, and neither section prohibits a reserve law enforcement officer from carrying a weapon in this state, regardless of whether the officer is engaged in the actual discharge of the officer's dties while carryiing the weapon.
